Galaxy Droid Terms of Service
Galaxy Droid (GD, Bot) is now an official product of Fearon Roleplay.

Effective Date: November 28th, 2025

These Terms of Service (“Terms”) govern your access to and use of the Galaxy Droid bot (the “Bot”) and any associated services (collectively, the “Service”). By inviting, installing or otherwise using the Bot, you (“User”) agree to be bound by these Terms and by Discord’s Terms of Service and Community Guidelines. If you do not agree with any provision herein, you must immediately discontinue your use of the Service.

1. Definitions
   • “Bot” means the Galaxy Droid application deployed on Discord.
   • “User” or “you” means any individual or entity that interacts with the Bot.
   • “Guild” means a Discord server in which the Bot is installed.
   • “Data” means any information or content collected, processed or stored by the Bot in the course of providing the Service.

2. License Grant & Scope
   2.1 Subject to these Terms, Galaxy Droid (“we,” “us,” “our”) hereby grants you a limited, non-exclusive, revocable, non-transferable license to use the Bot solely for your internal, non-commercial use in accordance with these Terms and Discord’s policies.
   2.2 You may not:
   • Decompile, reverse engineer or attempt to extract the source code of the Bot;
   • Distribute, rent, lease, sublicense or otherwise transfer rights to the Bot;
   • Remove or obscure proprietary notices on or within the Service.

3. User Conduct & Prohibited Activity
   3.1 You agree to use the Service lawfully and responsibly. You shall not, nor shall you encourage or assist any third party to:
   a. Violate any applicable law, including the Protection of Personal Information Act (POPIA) in South Africa;
   b. Harass, threaten, defraud or infringe the rights of others;
   c. Upload or transmit malware, viruses, unsolicited spam or any content that is unlawful, obscene, defamatory or discriminatory;
   d. Circumvent any security or access controls of the Service;
   e. Use the Service in a manner that adversely affects its performance or integrity.
   3.2 Any User who engages in prohibited activity may be subject to immediate suspension or termination of access, at our sole discretion, without refund.

4. Data Collection & Privacy
   4.1 The Bot collects minimal Data necessary for operation (e.g., Discord User IDs, messages for moderation, settings).
   4.2 We do not sell or share personal Data with third parties except to:
   • Comply with a valid court or regulatory order;
   • Enforce these Terms;
   • Protect our rights, property or the safety of others.

5. Intellectual Property
   5.1 All intellectual property rights in the Service, including but not limited to source code, branding, graphics and documentation, are owned by Galaxy Droid or its licensors.
   5.2 No rights are granted to you other than those expressly set forth in these Terms.

6. Disclaimers & Warranties
   6.1 The Service is provided “as-is,” “with all faults” and “as available,” without warranty of any kind, whether express, implied or statutory. We expressly disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability.
   6.2 We do not guarantee that the Service will be free of errors, malicious code or that it will operate without interruption.

7. Limitation of Liability
   7.1 To the fullest extent permitted by law, Galaxy Droid and its officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to these Terms or your use of the Service, even if advised of the possibility of such damages.
   7.2 Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of ZAR 100 or any fees you have paid us in the six (6) months immediately preceding the claim.

8. Indemnification
   You agree to indemnify, defend and hold harmless Galaxy Droid and its affiliates, officers, directors, employees and agents from and against any claim, liability, loss, damage or expense (including reasonable legal fees) arising out of or related to:
   a. Your breach of these Terms;
   b. Your misuse of the Service;
   c. Any claim that your conduct infringes or violates the rights of a third party or applicable law.

9. Termination
   9.1 We may suspend or terminate your access to the Service, with or without cause, at any time and without notice.
   9.2 Upon termination, your license to use the Service immediately ceases and you must remove the Bot from your Guild.

10. Changes to Terms
    10.1 We reserve the right to modify these Terms at any time.
    10.2 Material changes will be posted here with a new Effective Date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

11. Governing Law & Dispute Resolution
    These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be submitted to the non-exclusive jurisdiction of the South African courts.

12. Severability
    If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Entire Agreement
    These Terms, together with our Privacy Policy and Discord’s Terms of Service, comprise the entire agreement between you and Galaxy Droid concerning the Service and supersede any prior agreements or understandings.
